GENERAL |
- All EMCI certificate holders have to comply with the EMCI Rules for the right of complaint and disciplinary action and the EMCI Code of professional conduct.
- The rules and code is in power in additional to the national laws and regulations within the certificate holders ccompanies country of residence.
- If you wish to submit a complaint please completed the EMCI complaint reportform and EMAIL the signed & completed form to our mainoffice in the Netherlands.
- The complaint procedure includes thee steps:

- The complaint mediator starts the complaints mediation and tries to settle.
- If a settlement is not possible the complaint committee takes over. After managing the committee will publish its judgment.
- If either the complainant of the certificateholder is not satisfied an appeal can be filed with the Quality Standards Committee.

COSTS |
- Complaint fee: € 250,- ex Dutch. Payable by the complainant.
- Fee complaint mediator: additional € 25,- ex Dutch VAT / hour
- Fee complaint committee: additional € 25,- ex Dutch VAT / hour
- After completion of the complaint procedure either the certificate holder or the complainant have to pay all procedure costs. So finally the allocation of all costs are ruling-based. However, it is up to parties to make a different decision and allocate differently. Furthermore the EMCI managemnt can decide to take over all costs or to moderate.
- If a complainant does not fullfil its obligations inn relation to the procedure the procedure ends.
- If a certificate holder does not its fullfil its obligations in relation to the procedure the committee rules against the certificateholder. If the certificateholder does not pay the costs the certification will be suspended or expelled.
- Most insurance policies reimburse the complaint costs.

ADDITIONAL INFORMATION |
- The complaint procedure provides no material compensation. Material compensation is excluded in the Rules; if you wish to obtain material compensation you have to start up a court based civil procedure.
- The complaint procedure is a final-end procedure. Therefore all other procedures, including official courtbased procedures, must be completed before the EMCI complaint procedure starts.
- All EMCI certificate holders have the obligation to have a valid policy for the professional and company based lialibity.
